This note was prepared as comments to the Joint Parliamentary Committee of the Sixteenth Lok Sabha in response to the Bill No.144 of 2016. This bill contained amendments to the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI), the Recovery of Debts due to Banks and Financial Institutions Act, 1993 (RDDBFI), the Indian Stamp Act, 1899 and the Depositories Act, 1996. These amendments were proposed in May 2016 after the Insolvency and Bankruptcy Code was passed as law.
